1. Acceptance of Terms

By downloading, installing, or using Flash & Go ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. If you are a parent or guardian allowing a child to use the App, you accept these Terms on behalf of your child.

2. Description of the App

Flash & Go is a free camera application designed for children. The App allows children to take photos and videos, apply creative effects, and view their captured images in a safe, controlled environment. The App is intended for use by children under the supervision of a parent or guardian.

3. User Content

All photos, videos, and creative content ("User Content") created with Flash & Go are stored exclusively on your device in the App's private storage. User Content is:

• Not uploaded by us to a server or cloud service
• Exported to Photos only when a parent authorizes it; Photos and iCloud settings then apply
• Not received or accessed by the developer through app usage reports
• Subject to automatic deletion based on the retention settings you configure

You retain all rights to any User Content you create with the App. Flash & Go claims no ownership or license over your content.

4. Acceptable Use

You agree to use Flash & Go only for its intended purpose as a camera and photo application for children. The App should be used in accordance with all applicable laws and regulations.

5. Parental Responsibility

Flash & Go is designed for use by children. As a parent or guardian, you are responsible for:

• Supervising your child's use of the App as you see fit
• Configuring the App's settings appropriately for your child
• Saving any photos or videos you wish to keep permanently, as the App automatically deletes content based on your chosen retention settings

6. Privacy

Your privacy is important to us. The App stores media locally. Version 1.1 introduces optional parent-controlled anonymous usage sharing, off by default. For complete details, please review our Privacy Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

The Flash & Go app, including its design, code, graphics, icons, and user interface, is the intellectual property of the developer and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Use the App's name, logo, or branding without written permission
• Sublicense, sell, or redistribute the App

8. No Warranty

Flash & Go is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components
• Photos or videos will be preserved indefinitely or beyond the configured retention period
• The App will be compatible with all devices or operating system versions
• Any defects in the App will be corrected

9. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of photos or videos, loss of use, or any other intangible losses, arising out of or in connection with your use of or inability to use the App.

In no event shall the developer's total liability exceed the amount you paid for the App, which is zero dollars ($0.00) as Flash & Go is a free application.

10. Data Loss

Flash & Go stores photos and videos in the App's private sandbox on your device. These files may be deleted:

• Automatically, based on your configured retention settings
• By iOS, if your device is low on storage
• When the App is uninstalled
• By a parent using the "Clear All" function in parent settings

The developer is not responsible for any loss of photos, videos, or other content. If you wish to preserve content permanently, use the parent-authenticated save feature to export it to your Camera Roll.

11. Third-Party Services

The App is distributed through the Apple App Store. Optional usage reports are processed through our first-party collector and its hosting infrastructure as described in the Privacy Policy. Photos exported by a parent follow the device's Photos and iCloud settings. Your use of Apple services is governed by Apple's terms.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the developer regarding the use of Flash & Go and supersede any prior agreements.
